O Conselho Nacional do Ministério Público – CNMP – apresentou no mês passado, em 18 de junho, o Projeto Sistema Prisional em Números, com o objetivo de conferir maior visibilidade e transparência aos dados do sistema prisional brasileiro, a partir das visitas ordinárias realizadas pelos membros do Ministério Público de todo o País.
Segundo os dados apresentados, hoje no Brasil, cerca de 34 mil mulheres vivem atrás das grades. A maioria delas é mãe, provedora e está longe dos seus filhos e dos seus lares. Essas mulheres foram presas por diversos motivos. Mas mais da metade delas está presa por envolvimento com o comércio de drogas. De maneira geral, faziam transporte, vendiam pequenas quantidades ou eram usuárias.
Ainda de acordo com o relatório, 399 das presas no país são gestantes, o que representa 1,18% do total.
Quem são essas mulheres?
Entre os diferentes perfis de mulheres encarceradas sejam elas brasileiras, estrangeiras, jovens, idosas, com deficiência, lactantes, gestantes, mães de filhos pequenos ou mulheres em tratamento de saúde, um mesmo diagnóstico as une: a certeza de que para absolutamente todas as mulheres a experiência da prisão é mais uma forma de violência.
De acordo com o site mulheresemprisão, o poder judiciário brasileiro opera no sentido de prender, julgar e condenar mulheres sem levar em consideração possíveis medidas alternativas.
“Todas as pesquisas sobre o tema, nacionais e estaduais, revelam como esse encarceramento é seletivo. Ao encarcerar mulheres, o sistema de justiça opera de forma moral, tomando por modelo uma forma supostamente “correta” ou “desejável” de ser mulher – pura, dócil, afável, fiel – e penalizando aquelas que não se encaixam nessa norma.”
Para eles discutir e mudar a realidade é uma questão de direitos que não pode ser ignorada pela sociedade brasileira, principalmente quando o país já possui a quinta maior população feminina encarcerada do mundo, e ela cresce vertiginosamente. Só há um caminho: desencarcerar. Não se trata de “fazer menos justiça”. Na verdade, trata-se de promover um cenário de mais justiça.
Como alternativa apontam normativas que validam outra via que não o encarceramento, exatamente porque há mais gente e mais instituições mundo afora discutindo a importância das medidas alternativas à prisão. No Brasil, o Código de Processo Penal prevê a prisão domiciliar, mas ela ainda não é aplicada como deveria pelo Judiciário.
As Regras de Bangkok , documento celebrado no âmbito das Nações Unidas (ONU), que orientam os Estados-membros da ONU a priorizarem medidas não privativas de liberdade para mulheres respondendo a processos penais ou condenadas por algum crime. Diretrizes que vêm para reforçar a urgente necessidade de mudar o quadro de negligência, confinamento e abandono a que são submetidas as mulheres em conflito com a justiça.
