STF concede prisão domiciliar a mulheres grávidas e mães presas.
O Supremo Tribunal Federal (STF) decidiu nesta terça-feira (20) conceder prisão domiciliar a presas sem condenação gestantes ou que forem mães de filhos com até 12 anos. Estendido para mulheres em todo território nacional, a decisão beneficia em torno de 4,5 mil detentas, cerca de 10% da população carcerária feminina, segundo levantamento parcial do Instituto Brasileiro de Ciências Criminais (IBCCRIM), do Instituto Terra Trabalho e Cidadania (ITTC) e da Pastoral Carcerária Nacional.
Na sessão, as entidades apontaram condições degradantes a que os filhos das presas são submetidos quando nascem e são criados numa cadeia, argumentando que o encarceramento não pode se estender a eles.
“São espaços inadequados, com doença e violência, risco à vida e obstáculo a ambiente saudável e de cuidado familiar. Não pode a prisão alcançar os filhos. Não há hipótese na lei de prisão degradante”, disse a advogada Nathalie Fragoso, em nome do Cadhu, acrescentando que as prisões no Brasil são ambientes propícios para disseminação de doenças como a sífilis, que pode ser transmitida no parto para as crianças que nascem na cadeia.
Relator da ação, o ministro Ricardo Lewandowski foi o primeiro a votar favoravelmente ao pedido. Citando dados oficiais, destacou que apenas 34% das prisões femininas contam com dormitório adequado para gestantes, só 32% dispõem de berçário e somente 5% dispõem de creche.
Com base em estudos, ele considerou “duríssima” a situação das gestantes e mães de crianças presas no país. “Partos em solitárias sem nenhuma assistência médica ou com a parturiente algemada ou, ainda, sem a comunicação e presença de familiares. A isso soma-se a completa ausência de cuidado pré-natal (acarretando a transmissão evitável de doenças graves aos filhos, como sífilis, por exemplo), a falta de escolta para levar as gestantes a consultas médicas, não sendo raros partos em celas, corredores ou nos pátios das prisões, sem contar os abusos no ambiente hospitalar, o isolamento, a ociosidade, o afastamento abrupto de mães e filhos, a manutenção das crianças em celas, dentre outras atrocidades”, afirmou.
