Cesariana contra vontade

 

A Justiça do Rio Grande do Sul determinou que uma mulher de 29 anos grávida de 42 semanas fosse submetida a uma cesariana em um hospital de Torres, no Litoral Norte do estado, mesmo contra a sua vontade. A medida coercitiva foi expedida na noite de segunda-feira (31), após orientação de uma médica do Hospital Nossa Senhora dos Navegantes. Adelir Carmen Lemos de Goés acabou tendo a filha na terça-feira (1). As duas passam bem.

Stephany Hendz, a doula que seria assistente no parto, afirmou que os exames não apontavam risco e a mulher se negou a ficar no hospital. “A gente não tinha equipe para realizar um parto domiciliar, mas a gestante tinha o desejo de que fosse parto natural em uma instituição hospitalar. Um parto induzido assim se torna perigoso, porque força o útero da mulher. E uma terceira cesárea é muito arriscada”, afirmou . Adelir já é mãe de um menino de 7 anos e de uma menina de 2 anos.

No entanto, conforme a Justiça, segundo uma avaliação médica a gestante não poderia ser submetida a um parto normal, porque a criança estaria de pé no útero, e o bebê e a mãe estariam em risco.

“Foi verificado que o bebê estava em pé no útero, sendo necessária uma cesariana, por indicação médica. A mãe quis deixar o hospital para fazer o parto em casa e assinou um termo de responsabilidade”, explicou a juíza que expediu a decisão, Liniane Mog da Silva.

Acompanhada da doula, a gestante assinou um termo de responsabilidade onde alegava a  vontade de não ficar internada. “Eles nos humilharam dizendo que ela estava correndo risco. Mas pressão dela estava ótima, e o bebê estava bem. Nos negaram uma segunda opinião”, acrescentou Stephany Hendz ao dizer que a mãe queria realizar uma ecografia em outra instituição. “Eles usaram esse termo alegando que íamos fazer um parto domiciliar, mas não era isso que queríamos”, sustentou.

O marido de Adelir, Emerson Lovari, conta que a mulher teve problemas no segundo parto, e que o casal foi alarmado pela própria entidade. “A gente estava optando pelo parto natural. Ela estava com nove centímetros de dilatação, estava conseguindo”, lamentou o homem, que mora no bairro Campo Bonito, zona rural da cidade.

De acordo com nota oficial do Hospital Nossa Senhora dos Navegantes, a gestante apresentava dores lombares e na região do ventre. Após a realização de exames clínicos, a médica responsável constatou a necessidade de cesariana imediata para preservar a vida da paciente e do bebê. “Contrariando o diagnóstico e exigindo a realização de parto normal, a paciente assinou um termo de responsabilidade e voltou para sua residência, onde iria esperar o início de seu trabalho de parto, conforme informou à equipe plantonista”, explica o texto.

Ainda conforme o hospital, o Ministério Público foi informado sobre o caso com o objetivo de preservar “a saúde e integridade da mãe e do bebê”. O órgão, então, ajuízou medida de proteção com pedido de antecipação da tutela requerendo a condução da paciente ao hospital.

“Como o caso envolvia o interesse de menor, pois havia risco de vida não só para a mãe, mas também para o bebê, o hospital comunicou o Ministério Público, que ingressou com a medida de proteção. A medida foi concedida e o cumprimento pela oficial de justiça foi tranquilo, sendo que a Brigada Militar apenas acompanhou para garantir a segurança”, completou a juíza Liniane.

“Antecipo a tutela para determinar, primeiro, o encaminhamento coercitivo ao Hospital Nossa Senhora dos Navegantes, a fim de que a gestante receba o atendimento médico adequado para o resguardo da vida e integridade física do nascituro, inclusive com a realização do parto por cesariana, se essa for a recomendação médica no momento do atendimento”, diz o texto da decisão judicial.

Conforme Adelir, eles acharam a decisão precipitada. “Vieram duas viaturas da Brigada Militar e uma ambulância nos buscar em casa. Ficamos nervosos. Por pouco não fui algemado”, falou, alegando agressão verbal por parte da polícia.

A paciente deu entrada novamente no hospital às 2h40 de terça-feira (1), conduzida pelo oficial de justiça. Ela já estava em trabalho de parto. O nascimento do bebê, uma menina, se deu às 3h10. Segundo a nota do hospital, o procedimento cirúrgico foi realizado com sucesso e sem intercorrências, e mãe e a criança passam bem.

“Vou processar o hospital e a médica com certeza. Imagina, tu estás em casa com crianças, entra a polícia e tu és tratado como um marginal”, reclamou o pai.
