Nos últimos dias, vieram a público seis casos de assédio sexual no trem e no metrô de São Paulo que chocaram a população. Na segunda-feira 17, um estudante universitário foi preso em São Paulo por tentativa de estupro contra uma mulher que utilizava a Linha 7 – Rubi da Companhia de Trens Metropolitanos (CPTM). O homem foi acusado de cercá-la em um canto do trem, torcer seu braço, colocar o órgão genital para fora da calça e ejacular nas pernas da vítima. Detido e levado pela Delegacia de Polícia do Metrô, o criminoso foi autuado em flagrante por estupro. Dias depois, na quarta-feira 19, dois jovens foram presos apalpando as nádegas de duas adolescentes na estação Sé. Na quinta-feira 20, mais três homens foram autuados pela Delegacia de Polícia do Metropolitano (Delpom) de São Paulo. Os atos foram considerados importunação ofensiva ao pudor. Ao todo, 23 pessoas foram detidas por esse delito na capital paulista este ano. Casos de abusadores que se aproveitam da superlotação do transporte público urbano para praticar assédio sexual ocorrem há décadas. As últimas denúncias, no entanto, jogaram luz sobre uma série de páginas em redes sociais e sites criminosos que reúnem grupos que praticam esse tipo de violência e publicam fotos e imagens do momento da violação, os chamados encoxadores. A ONG Safer Net Brasil, que atua contra crimes na rede, registrou apenas na semana passada 19 denúncias sobre páginas de abusadores que cometem atos ilícitos no metrô e nos trens. “Com a popularização dos smartphones, a internet passou a ser uma vitrine para atos de violência cotidiana”, afirma Thiago Tavares Nunes de Oliveira, presidente da ONG.

Das 21 páginas existentes, seis foram tiradas do ar pelo Google e uma pelo Facebook. O grande perigo desse fenômeno, de acordo com Oliveira, é que a publicação do conteúdo esteja gerando uma competição. “Antes, os abusadores praticavam esse crime e ficavam calados; hoje as imagens passaram a ser exibidas como se fossem troféus”, diz. Especialista em abuso sexual, a psicanalista Ana Maria Iencarelli classifica esse comportamento como síndrome do pequeno poder. “O homem usa a ameaça da força física, da intimidação, e a ideia de submissão feminina em relação a ele”, afirma. Homens com esse tipo de comportamento sentem mais prazer em experimentar a relação de poder do que trocar prazer sexual. Casos de abuso sexual no transporte público ocorrem com muito mais frequência do que as estatísticas indicam, uma vez que a maioria das mulheres não denuncia.

No ano passado, a ajudante de serviço social, Roseane Ribeiro Arévalo, 28 anos, voltava à noite para casa pela Linha 3 – Vermelha do Metrô de São Paulo. “Quando levantei a cabeça havia um homem na minha frente, me olhando, com o órgão genital para fora, se masturbando”, diz a jovem, que não esboçou nenhuma reação. “Fiquei apavorada e desci na estação seguinte.” Rose procurou um segurança do Metrô, mas foi desestimulada pelo guarda a denunciar.

Esse tipo de assédio não ocorre apenas no Brasil. Fenômeno conhecido como “frotteurismo” (ato de se esfregar em outra pessoa), nos Estados Unidos é chamado de “groping” (tateando) e no Japão é batizado de chikan (molestador). Segundo Maria Fernanda Marcelino, membro da Sempre Viva Organização Feminista (SOF), no mundo todo há uma banalização da violência contra a mulher. “Persiste a ideia de que a sexualidade dos homens é algo incontrolável e, por isso, quem deveria ter cuidado são elas”, diz. Para Maria Fernanda, as tevês dos ônibus e dos metrôs deveriam ser utilizadas para campanhas de conscientização. E mais: as estações deveriam ter postos de atendimento para que as vítimas construíssem retratos-falados do agressor. “Com esses relatos e o sistema de imagens, os seguranças poderiam identificar mais facilmente os abusadores.” Apesar de a polícia ter intensificado as investigações, esse tipo de ação tem se proliferado, já que a maior parte das violações é considerada crime leve. “Os homens são autuados por importunação ofensiva ao pudor, notificados e o juiz pode aplicar uma pena alternativa, como prestar serviços à comunidade ou pagar algum tipo de indenização às vítimas”, afirma Osvaldo Nico Gonçalves, delegado da Divisão Especial de Atendimento ao Turista (Deatur), à qual se subordina a Delpom.

O delegado afirma que a polícia continuará investigando nas próximas semanas sites criminosos dos chamados encoxadores. “Estamos levantando o número dos IPs para identificar de onde o usuário está acessando a rede”, diz Gonçalves. Além disso, outra iniciativa em curso é a infiltração de seguranças à paisana nos vagões para flagrar atos de violência contra a mulher. Para a doutora em direito pela Universidade de Brasília e autora do livro “Criminologia Feminista”, Soraia da Rosa Mendes, poucos crimes como esses são caracterizados como estupro em função da dificuldade na obtenção das provas e do baixo índice de investigação. “As denúncias vindas de mulheres costumam ser desconsideradas pelo Judiciário brasileiro”, afirma. “Alguns estereótipos, como a roupa que a mulher usa, estão na mente de quem opera o sistema judicial.” Para a secretária nacional de enfrentamento à violência da Secretaria de Políticas para Mulheres da Presidência da República, Aparecida Gonçalves, as vítimas devem fazer a denúncia em qualquer situação. “Cada vez que deixamos de denunciar por medo ou vergonha, estamos abrindo espaço para esse tipo de crime”, diz.

Em março de 2006, foi criada no Rio de Janeiro uma iniciativa para diminuir o assédio sexual em transportes públicos. A então governadora Rosinha Garotinho (PR) sancionou uma lei que obriga os sistemas metroviário e ferroviário do Estado a destinar vagões exclusivos às mulheres nos horários de pico de manhã e à tarde. O vagão é sinalizado pela cor rosa e quando um homem tenta entrar no espaço, os seguranças pedem que ele se retire. A iniciativa, que também é praticada no Distrito Federal, não acabou com os casos de assédio. A professora Aglaupe Damasceno, 22 anos, usa diariamente o trem e o metrô, mas diz que raramente está sozinha na condução. “Os homens costumam encostar as partes íntimas, esse contato dá nojo, mas fico com medo e não sei como reagir.” A supervisora pedagógica Verônica Lima, 28 anos, afirma que o assédio ocorre até nos vagões exclusivos. “Na hora do rush não tem jeito, a gente tenta escapar, mas eles nos seguem e esfregam pernas e braços”, diz. Para a especialista da Universidade de Brasília (UnB) Soraia Mendes, é preciso reformular a cultura machista. “Não é porque um vagão está cheio que alguém pode violar a dignidade de outra pessoa.”
